1. Service Delivery & Milestones
All projects are executed according to agreed-upon milestones outlined in the service contract. Payment schedules are tied to milestone completion to ensure transparency and accountability.
2. Refund Eligibility
Refunds are evaluated on a case-by-case basis according to the following criteria:
- If work has not yet commenced, a full refund may be issued within 14 days of payment
- If work is in progress, refunds are calculated based on completed milestones and hours invested
- If the delivered work does not meet the specifications agreed upon in the contract, marbleshiftroot will rectify issues at no additional cost before any refund is considered
3. Non-Refundable Items
- Third-party licenses, domain purchases, or hosting fees already incurred
- Work completed and approved by the client at intermediate milestones
- Custom design work that has been delivered and implemented
4. Refund Process
To request a refund, contact [email protected] with your project details and reason for the request. Refunds are processed within 14 business days of approval to the original payment method.
5. Dispute Resolution
Any disputes arising from this refund policy will be subject to the jurisdiction of the courts in Barcelona, Spain, in accordance with EU consumer protection regulations.
Terms of Service
By accessing and using the services provided by marbleshiftroot, Calle de Sardenya, 202, P01 2, 08013 Barcelona, Spain, you agree to the following terms and conditions.
1. Service Scope
marbleshiftroot provides enterprise-grade web development, design, and infrastructure services. All services are executed according to the specifications outlined in individual project contracts and service agreements.
2. Payment Terms
- Invoices are due within 14 days of issuance unless otherwise specified
- Late payments may incur a 1.5% monthly interest charge
- All prices are quoted in EUR and are exclusive of applicable VAT
- Payment links provided by marbleshiftroot are secure and processed through certified payment providers
3. Intellectual Property
Upon full payment, marbleshiftroot transfers ownership of all custom code, designs, and deliverables to the client. marbleshiftroot retains the right to display work in portfolios and case studies unless explicitly restricted in the contract.
4. Confidentiality
Both parties agree to maintain strict confidentiality regarding proprietary information, trade secrets, and business strategies shared during the course of the engagement.
5. Limitation of Liability
marbleshiftroot's total liability shall not exceed the total value of the services provided under the relevant contract. We are not liable for indirect, consequential, or incidental damages.
6. Service Level Agreement
marbleshiftroot commits to a 99.9% uptime guarantee for hosted platforms. Support inquiries are responded to within 24 hours during business days.
7. Termination
Either party may terminate the agreement with 30 days written notice. marbleshiftroot will deliver all work completed up to the termination date, and payment is due for all milestones achieved.
8. Governing Law
These terms are governed by the laws of Spain and the European Union. Any disputes shall be resolved in the courts of Barcelona, Spain.
9. Changes to Terms
marbleshiftroot reserves the right to modify these terms. Updated terms will be effective upon posting. Continued use of services constitutes acceptance of modified terms.
